What Does the Resale Form Cover?

This official TREC document, formally titled the Residential Condominium Contract (Resale), transfers ownership of a previously owned condo unit included in the sale. The agreement establishes the binding terms between a buyer and seller, covering the purchase price, earnest money deposit, financing arrangements, and the specific unit being transferred. The Texas Real Estate Commission created the form to protect both parties and ensure full legal disclosure throughout the transaction.

One of the most important attachments to this form is the resale certificate, which the condominium association (HOA) must prepare and deliver to the buyer before the sale closes. The resale certificate discloses the financial health of the association, current and pending assessments against the unit, the reserve fund balance, and the governing rules of the condominium project. Texas law gives the buyer a review period after receiving the resale certificate. If the buyer finds the certificate unsatisfactory, they may cancel the contract within this window and receive a refund of their earnest money from the title company.

Beyond the resale certificate, the form addresses several other critical items. It specifies which records the seller must deliver, including the condominium declaration, bylaws, and rules governing the common areas and restrictions on the unit. The form also covers lender-required repairs, the title policy commitment, environmental disclosures, and the agreed closing date.
