Form 1034 Status Conference Statement PDF Details

On June 1, 2017, the Internal Revenue Service (IRS) released Form 1034. The form is used to provide a status conference statement for a proposed or pending section 1034 transaction. A section 1034 transaction is one in which the transfer of real property from a seller to a buyer qualifies as a like-kind exchange under section 1031 of the Internal Revenue Code (Code). Generally, when an asset is exchanged in a like-kind exchange, no gain or loss is recognized for federal income tax purposes. The release of Form 1034 provides taxpayers and their advisors with important information on how the IRS will process these transactions. The form can be filed by either party in a proposed or pending section 1034 transaction and must be filed within 30 days after the date of the first written notice that the IRS has made regarding the potential disallowance of any part of the like-kind exchange.
