In the realm of vehicle transactions, various situations may necessitate the rescission of a motor vehicle sale, where essentially, a completed sale is undone, and the vehicle is returned to the seller. The Massachusetts Department of Revenue provides a form known as the MV-AB2 Affidavit — Rescission of Sale of a Motor Vehicle for this exact purpose. This essential document serves as a formal declaration by both the buyer and the seller that they have agreed to reverse the sale. The form is thoughtfully divided into two main parts. Part 1 requires information from the purchaser, including details about the vehicle, the purchase, and the return. Part 2 is filled out by the seller, who must indicate whether the vehicle was returned to stock, if the sale was completely rescinded, and if any funds were refunded, excluding registration fees and taxes. Both parties are also required to attest to the truthfulness of their statements under the threat of perjury, highlighting the seriousness with which this document is treated. To successfully apply for an abatement — a component of rescinding a sale that could lead to a refund of the purchase price minus certain fees — the seller and purchaser must complete and sign the MV-AB2, following specific instructions laid out by the Department. This process not only underscores the legal and financial implications of rescinding a vehicle sale but also serves to protect both parties involved in the transaction.
