A letter of intent to marry should be submitted by both fiancé and fiancée. The document is proof of their mutual intent to marry within 90 days and their legal ability to do so.

What Should Be Included in a Letter of Intent to Marry?

A letter is a simple document but it is essential to demonstrate the plans of the fiancé and fiancée to marry within 90 days after entering the United States when one person in a couple is not a US resident. Having signatures of the US resident and K-1 applicant is a legal requirement of the USCIS.

When it comes to the petitioner’s/beneficiary’s signature, the official instructions to filling the form tell about the need to sign the form, but they don’t specify whether or not the signature should be original and “wet”. It means that both the fiancé and fiancée should submit the letters with their signatures, and the form might be scanned, photocopied, faxed, or emailed.

Usually, the letter goes in the form of a common piece of paper (about 8.5×11), and it might be complemented by some other evidence to justify the marriage intentions of the couple.

What Other Evidence Can Be Used?

The I-129F (Petition for alien fiancé) might also be accompanied by certain documents that will let US Citizenship and Immigration Services officers have more evidence of two individuals’ intention to marry each other within 90 days after the beneficiary’s coming to the US. Among such documents are:

  • agreement of ordering marriage catering services in the US
  • agreement of renting a marriage venture, any pictures and plans of the future wedding in the US
  • agreements with musicians, DJ, wedding planner, etc. in the US
  • documents that prove plans for the honeymoon
  • any proof of communication on wedding plans between fiancé and fiancée

The abovementioned documents are not necessary for USCIS officers, and a fiancé letter of intent to marry is generally enough.

How to Fill Out a Letter of Intent to Marry

A letter of intent to marry is a short document that states a person’s intention to marry within 90 days when a couple wants to apply for the K-1 visa. It can be filled in several simple steps.

Step 1 – The recipient and subject

The letter should start with the recipient, USCIS, and its filing address that the letter will be sent to. This information should be included in the top left corner of the document.

The subject should also be mentioned. It should specify the type of petition – I-129F Petition for alien fiancé.

Step 2 – Name of the petitioner/beneficiary, their address, and contact information

The letter should specify the name of the alien fiancé petitioner and the name of the beneficiary. The contact information and address in the United States should also be mentioned in the LOI.

Step 3 – Statement

The next step is to write the statement about the intention to marry the beneficiary/petitioner.

It should start with “to whom it may concern” or “Dear USCIS officer”. Then, it should specify the name of the petitioner/beneficiary and their status. Further, the petitioner/beneficiary should tell them they are legally able and willing to marry the beneficiary/petitioner within 90 days after the beneficiary is coming to the United States using the K1 visa procedure.

Step 4 – Attachments

The evidence of the petitioner’s/beneficiary’s on-going plans to marry should complement the statement. It might be a receipt for catering services, DJ, florist, etc. Among the attachments might also be samples of wedding invitation cards.

Step 5 – Closing

The petitioner/beneficiary should thank the USCIS officer for considering their letter and to feel free to contact them in case of any questions regarding the I-129F petition.

Step 6 – Signature

Putting the petitioner’s/beneficiary’s signature is the final step to finishing the document. It should include the date and their print name as well.
