Boe 502 A Form PDF Details

In the realm of real estate transactions, certain forms and reports play pivotal roles, not only in the execution of transactions but also in the aftermath, particularly in terms of tax implications. Among these, the BOE-502-A form, officially known as the Preliminary Change of Ownership Report (PCOR), stands out as a critical document for individuals navigating the transfer of property in California. This form is designed to be completed by the buyer or transferee before the conveyance of the subject property is finalized. Mandated by section 480.3 of the Revenue and Taxation Code, the PCOR serves multiple purposes, including the provision of essential information to county assessors to assist in determining the applicability of certain property tax reassessment exclusions. The form encompasses a wide array of transfer scenarios, stretching from simple corrections of the name(s) on the property title to more complex situations like transfers between spouses, domestics partners, parents and children, or even in conjunction with significant life events such as a cotenant’s death. Moreover, it delves into the financial nuances of the transaction, detailing the purchase price, terms of sale, and any inclusion of personal or business property in the transaction. By furnishing details like the type of property transferred, the presence of any leasing agreements, and the condition of the property at the time of sale, the BOE-502-A form plays an indispensable role in the equitable assessment of property taxes post-transfer. Its comprehensive structure ensures that all relevant information is captured, thereby facilitating a smoother transition of property ownership and the fair application of property tax laws.

MAIL PROPERTY TAX INFORMATION TO: Enter the name, address, city, state, and zip code where property tax information should be mailed. This must be a valid mailing address.

PRINCIPAL RESIDENCE: To help you determine your principal residence, consider (1) where you are registered to vote, (2) the home address on your automobile registration, and (3) where you normally return after work. If after considering these criteria you are still uncertain, choose the place at which you have spent the major portion of your time this year. Check YES if the property is intended as your principal residence, and indicate the date of occupancy or intended occupancy.

PART 1: TRANSFER INFORMATION

If you check YES to any of these statements, the Assessor may ask for supporting documentation.

C,D,E, F: If you checked YES to any of these statements, you may qualify for a property tax reassessment exclusion, which may allow you to maintain your property’s previous tax base. A claim form must be iled and all requirements met in order to obtain any of these exclusions. Contact the Assessor for claim forms. NOTE: If you give someone money or property during your life, you may be subject to federal gift tax. You make a gift if you give property (including money), the use of property, or the right to receive income from property without expecting to receive something of at least equal value in return. The transferor (donor) may be required to ile Form 709, Federal Gift Tax Return, with the Internal Revenue Service if they make gifts in excess of the annual exclusion amount.

N:Check YES only if property is subject to subsidized low-income housing requirements with governmentally imposed restrictions; property may qualify for a restricted valuation method (i.e., may result in lower taxes).

O:If you checked YES, you may qualify for a new construction property tax exclusion. A claim form must be iled and all requirements met in order to obtain the exclusion. Contact the Assessor for a claim form.
