The Civ 120 Form is the Judicial Council of California's official document for filing a Notice of Entry of Dismissal and Proof of Service. When a California court enters a dismissal in a civil case, the dismissing party must serve a copy of the signed order on all other parties and file proof of that service using this document.
Plaintiffs, defendants, or their attorneys in California Superior Court proceedings use this form to document dismissed cases. It covers a wide range of case types including personal injury, property damage, wrongful death, motor vehicle accidents, family law matters, and eminent domain. Self-represented parties appearing without an attorney may also complete and file it.
This document has two parts. The first part, the Notice of Entry of Dismissal, identifies the court, the parties, and the case number, and certifies that a copy of the entered dismissal is attached. The second part, the Proof of Service, documents how and when the notice was delivered to each party.
Under California law, this document may be served by mail, personal delivery, or electronic means. Electronic service is allowed when all parties have agreed to it. The declarant completing the proof of service must be at least 18 years old, not a party to the case, and a resident of or employed in California.
