Under Section 8 of the Flammable Fabrics Act (15 U.S.C. 1191) and the Regulations issued thereunder by the Consumer Product Safety Commission (16 CFR 1608), any person residing in the United States and marketing or handling products, fabrics or related materials subject to the Act for which flammability Standards have been issued, amended or continued in effect under the Flammable Fabrics Act may file a continuing guaranty with the Commission.

Any person or firm that elects to file a continuing guaranty is required to maintain written records which show that the guaranties are based on test results which demonstrate conformance with reasonable and representative tests prescribed by the Consumer Product Safety Commission as set out in the Regulations issued in conjunction with the individual Standards.

In all cases the guaranty must be based on tests performed on the product, fabric or related material by or on behalf of the guarantor or on guaranties received from the guarantor’s supplier to the effect that such tests have been performed.

The continuing guaranty may be filed with the Commission by submitting the fully executed forms, in duplicate, to the Consumer Product Safety Commission, Office of the Secretary, 4330 East West Highway, Bethesda, MD 20814.

In preparing a continuing guaranty for filing with the Consumer Product Safety Commission, the following should be carefully noted:

(a)The form should be filed in duplicate with the impression of the official seal of the notary public on each copy filed.

(b)The form should correctly describe the guarantor’s business organization.

(c)The filing of the guaranty is optional, but if it is filed the guarantor must maintain written records which show the guaranteed products have been tested and conform with reasonable and representative tests as specified in the Regulations issued by the Commission.

Continuing guaranties filed with the Commission are renewable every three years and at such other times as any change occurs in the legal business status of the guarantor. The guarantor shall promptly report any such change to the Commission and advise the Commission of any change in the address of his principal office or place of business.
