Form Bp 1 PDF Details

For many homeowners embarking on renovations or constructions within their 1, 2, 3, or 4 family, owner-occupied residences, including condominiums, understanding the nuances of workers' compensation insurance requirements is crucial. The BP-1 form offers a way for certain homeowners to certify they are exempt from providing specific proof of workers’ compensation insurance coverage when applying for a building permit. The affidavit stipulates that the homeowner is either performing all work themselves, not compensating anyone to assist in the work, or if hiring help, doing so for less than 40 hours a week in aggregate and has a current homeowner’s insurance policy covering the property. However, if the work exceeds 40 hours a week, the homeowner must then either submit proof of obtaining workers' compensation coverage with forms approved by the Chair of the NYS Workers’ Compensation Board or verify that the general contractor has the necessary coverage or exemption. This legislative measure, outlined in the laws of New York, ensures that both homeowners and workers are protected during the construction process, underlining the importance of compliance for a smooth and lawful renovation or construction project.
