Form Dc 628 PDF Details

The DC 628 form serves as a pivotal document within the judicial system of the Commonwealth of Virginia, encapsulating the essence and complexity of support orders in civil matters. This form, routinely utilized by both the Juvenile and Domestic Relations District Courts and Circuit Courts, outlines the allocation and stipulation of support—be it temporary or final—for children, spouses, or even parents in certain circumstances. Crafted to detail the specifics of support including the amount, the division amongst dependents, and the conditions under which the support is to be provided, this document addresses various requirements and contingencies. Furthermore, it elaborates on arrearages, designating how past due amounts are to be handled, along with associated interest charges. The DC 628 form recognizes the importance of healthcare provisions, requiring the responsible party to furnish necessary health or dental care coverage. It goes a step beyond by addressing tax considerations, potentially altering the right to claim dependents for tax purposes based on the fulfillment of support obligations. Additionally, this form mandates precise payment modalities, emphasizing the significance of compliance and the consequences of failure to adhere to the ordered support. Through its comprehensive composition, the DC 628 form underscores the court's commitment to ensure financial support for dependents, while also considering the financial capability and responsibility of the payer.

NOTICE: Support payments may be withheld as they become due from income without further amendment of this order or having to file an application for services with the Virginia Department of Social Services. Such order shall only be entered upon motion after proper notice sent by the clerk or counsel. If a change in circumstances, as defined in the State Board of Social Services’ regulations, has occurred, the Department shall report its findings and a proposed modified order to the court which entered the order. Notice shall be served on both parties. Either party may request a hearing on the proposed modified order by filing a request with such court within 30 days of receipt of notice by the requesting party. Virginia Code § 20-60.3.

In cases enforced by the Virginia Department of Social Services, the Department of Motor Vehicles may suspend or refuse to renew the driver’s license of any person upon receipt of notice from the Virginia Department of Social Services that the person is delinquent in the payment of child support by 90 days or in an amount of $5,000 or more, or the person has failed to comply with a subpoena, summons, or warrant relating to paternity or child support proceedings.

If the order being reviewed by the Department deviates from the guidelines, based on one or more factors set out in Virginia Code § 20-108.1, a hearing shall be scheduled with the court which entered the order.
