PETITION FOR RULE TO SHOW CAUSE AND INTRUCTIONS
Purpose
This information is meant for parties who want to enforce any provisions of a Judgment for Dissolution of Marriage or Order that was previously entered by a judge. For this Petition for Rule to Show Cause to Apply, there must be a specific act that the other party was ordered to do by a judge, and that party failed to comply with his/her obligation. For example, if your ex-spouse is not making child support payments even though he/she was ordered to do so by a judge in your Judgment for Dissolution of Marriage, you may file a Petition for Rule to Show Cause with the court. By filing the Petition for Rule to Show Cause with the court, you are saying that you have tried (and failed) to work things out with your ex-spouse. You are also asking the court to make your ex-spouse appear in court and to explain why he/she did not comply with the order. You cannot use this form if all you want to do is change or modify a provision of the Judgment or the Order.
How to File the Petition at Court
To file the Petition for Rule to Show Cause at court:
1)Make three copies of the Petition for Rule to Show Cause.
2)Make three copies of your Judgment of Dissolution of Marriage, or the order you are trying to enforce.
3)If the order was entered as part of your divorce case, go to Room 802 of the Richard J. Daley Center at Clark and Randolph Streets in Chicago. If your order was entered as part of your paternity case, then go to Room 200 at 28 North Clark Street.
4)Go to the Motion Counter and get a Motion Slip. Write the name of your case, the case number, and the title of your petition in the spaces on the motion slip.
5)If at the Daley Center: Give the motion slip to the clerk at the Motion Counter. The clerk will tell you who your judge is and your court date. Then go to the Filing Counter and give your petition to the filing clerk. They will keep the original and give you back stamped copies.
6)If at 28 N. Clark: Give the clerk your motion slip and Petition. The clerk will tell you who your judge is and your court date. The clerk will keep your original Petition and give you back stamped copies.
How to Complete the Form
You have two choices. You can fill in the form on your computer and then print the form. Or, you can print the form from your computer and fill in the form with a pen or typewriter.
To use your computer to fill in the form, move your mouse over the lines you need to fill in and start typing your information. If you want to erase all of the
information you have typed in the form, click on the “form reset” button on the last page of the form.
Please note that you cannot type in the spaces where your signature is required.
Each numbered instruction corresponds to the same number on the Petition for Rule to Show Cause Form.
Note: to say that your ex-spouse’s action have been “willful, contumacious and without just cause,” means that your ex-spouse had no good reason for not paying child support.

10)Insert the part of the Judgment of Dissolution of Marriage (or Order) that is
being violated by the other party. 11)Insert the name of your ex-spouse.
12)List the dates that your ex-spouse violated the Judgment of Dissolution of Marriage (or Order) and how he/she violated it. For example, “child support was not paid on March 3, 2003 and May 3, 2003.”
13)Insert the name of your ex-spouse. 14)Insert your name.
15)Insert the name of your ex-spouse.
16)Insert “he” is your ex-spouse is male. Insert “she” is your ex-spouse is female.
