The New Jersey POA and Declaration by Authorized Agent (DAA) is a document that authorizes a representative to handle International Registration Plan (IRP) and International Fuel Tax Agreement (IFTA) matters on behalf of a registrant.
1. Fill Out the Registrant/Licensee Section
Enter the full legal name of the registrant or licensee. This must match the name associated with the IRP and IFTA accounts. Next, provide the Federal Employer Identification Number (FEIN) or Social Security Number (SSN) registered with the IRP and IFTA accounts. Include a contact telephone number and an email address for official communications.
2. Enter Authorized Agent Information
Specify whether the agent is an individual or a motor carrier service provider company. If the agent is an individual, enter their name and contact information, including telephone number, fax number, and email address. If representing a company, a list of all employees authorized to act as agents must be provided to the Commission, including their names, signatures, driver’s license photocopies, and email addresses. Provide the contact details for the agent or company.
3. Specify the Acts Authorized by the Registrant/Licensee
Declare the specific powers granted to the agent. This includes the authority to handle IRP and IFTA transactions, access confidential information, and represent the registrant in audit or collection matters. It should be noted that the agent cannot endorse checks, execute compromise consents, or sign documents that require the registrant’s attestation. Attach a photocopy of the registrant’s driver’s license as required.
4. Signature and Notarization
The registrant must sign and date the form, stating their title or relationship to the carrier company. This section must be completed in the presence of a notary, who will verify the registrant’s identity and attest to the document’s signing. The notary will then fill in their details, affix their seal, and indicate the type of identification produced by the registrant.
5. Complete the Declaration of Authorized Agent
On the second page of the form, the agent must acknowledge their understanding and acceptance of the responsibilities and limitations associated with the powers granted. The agent should confirm their familiarity with the IRP and IFTA requirements and the MVC’s procedures. The agent signs and dates this section to validate the POA.
6. Submission
After ensuring all sections are filled out correctly, and both the POA and DAA are signed and notarized, submit the completed form to the Motor Carrier Services at the address provided on the form.
