For example, if the parents are planning a long vacation together, leaving their minor children behind, they should appoint a legal guardian in advance.

When appointing a guardian, make sure that your children are comfortable with this particular person in the first place. Only the minor’s parents or an existing legal guardian can perform such actions. All principals must give their written consent for transferring custody, even temporarily.

Each state has laws that govern custody and guardianship rights of minor children, and Pennsylvania is not an exception. According to the local legislature, one would need to use the Pennsylvania Minor Child Power of Attorney Form to assign temporary custody rights to another person.

The Pennsylvania Code (Chapter 231, Title 1915) regulates all actions regarding both legal and physical custody and guardianship in the state. In some cases, the Uniform Child Custody Jurisdiction and Enforcement Act comes into force. Under these regulations, the court can exercise or decline jurisdiction over the case.

On behalf of minor child: first parent, guardian or conservator
Enter your name and address, then put your initials on the line beside Parent, Court-Appointed Guardian or Court-Appointed Conservator. Next, enter the child's name, date of birth and address. Check that the name and date of birth match the child's birth certificate.
Second parent and the agent
Likewise, fill in the second blank section for the second parent or a co-guardian (if applicable). Then enter the name and address of the agent (attorney-in-fact) you appoint for the child.
Purposes and successor attorney-in-fact
In the next section, the parents or the legal guardian must define the scope of powers assigned to the Attorney-in-Fact and establish the period of temporary custody.
Choose option 1 for all authority, or option 2 for limited authority and write what the agent may do on the line. In this case, the confidants must detail the extent to which this authority will be restricted. Then enter the name and address of the alternate agent, the successor attorney-in-fact.
Effective date
Enter the date the power of attorney starts and the date it continues until. The principals have the legal right to revoke a power of attorney at any time.
Sign and date the document
Read the statement about parental rights, fill in the day, month and year, then sign and print your name on the lines. A second parent or guardian uses the second signature line.
Acknowledgment: state, county and officer
Leave page 3 for the notary or officer. The county, the date, the officer's name and title and the name of the person appearing are filled in at the signing.
Officer signature and seal
The officer who completes the acknowledgment signs the Signature line and adds a seal.

Sign the document
All the existing principals and the Attorney-in-Fact must put down their signatures and printed names as a sign of consent.
Add the witnesses
Two witnesses are required to enforce the guardianship. They also need to sign the document and put down their printed names.
Have the document notarized
At the final stage, the notary public shall provide for notarization and thus confirm the document’s execution.
Keep copies
Make a copy of the signed document for each person named in it, and store the original where you can find it.
