What Is a California Preliminary Notice for Private Works?

In California, the Preliminary Notice for Private Works is a mandatory legal document governed by Cal. Civil Code § 8200 et seq. that contractors, subcontractors, suppliers, equipment lessors, and laborers must serve on property owners, original contractors, and construction lenders to preserve their right to file a mechanics lien if not paid for labor, materials, equipment, or services furnished to a private construction project.

The notice must be served within 20 days of first furnishing work to the project. If served late, lien rights apply only to work provided during the 20 days before service and afterward. Work furnished more than 20 days before service is not covered. The notice must include: the claimant's name and address, the name of the party who hired the claimant, the property owner's name and address, a description of the jobsite, the name of any construction lender, and an estimated price of the labor, materials, or services to be furnished.

Service must be made by personal delivery, first-class certified mail with return receipt requested, or registered mail. The claimant must retain proof of service (postal receipts, delivery confirmations) as documentation. Failure to properly serve the notice eliminates the claimant's right to file a lien and collect payment through that mechanism under California law.

Property owners who receive this notice should require lien releases or conditional waivers from each notifying party before making final payment to the general contractor, and file a notice of completion promptly to limit the time frame for lien claims.
