Notice Of Rent Increase Form N2 PDF Details

Every renter dreads the moment they receive a notice of rent increase, but understanding the nuances of the Notice Of Rent Increase N2 form is essential for both tenants and landlords who are managing properties partially exempt from standard regulations. This particular notice, a crucial document prescribed by housing authorities, outlines the terms under which a landlord can implement a rent increase, specifying the new rent amount, the effective date of the increase, and the inclusion of any additional charges separate from the base rent. Importantly, it highlights that the standard guideline for rent increases, set by the Ministry of Municipal Affairs and Housing, does not apply to certain rental units, freeing landlords of these properties to increase rent by any amount, provided they issue the notice at least 90 days in advance. The notice further clarifies tenants' rights concerning lease renewal and the termination of tenancy, offering crucial guidance on how to respond to the increase. Contact information for the Landlord and Tenant Board is also provided, ensuring tenants and landlords have access to help should they have questions about the increase or about rent regulation laws more broadly. This introduction of the Notice Of Rent Increase N2 form paints a broad picture of its purpose, implications, and the legal framework surrounding rent adjustments in specialized housing situations.

This rent includes the basic rent for your rental unit and any amount you pay separately to your landlord for services. However, if you live in a care home, this rent does not include charges for care services or meals.

1.The guideline for rent increases set by the Ministry of Municipal Affairs and Housing does not apply to tenants who live in rental units that are partially exempt from the RESIDENTIAL TENANCIES ACT, 2006.

In these cases, the landlord can raise the rent by any amount.

2.The landlord must give the tenant this notice at least 90 days before the date of the rent increase (where applicable).

3.A tenant does not have to sign a new lease when a fixed term tenancy ends. If the tenant decides not to sign a new lease, the tenant does not have to move, but the tenancy becomes "month-to-month".

If a tenant plans to move, the tenant must notify the landlord on Form N9 (Tenant's Notice to End the Tenancy) at least 60 days before the lease expires if the tenant has a fixed term tenancy or 60 days before the end of a monthly or yearly rental period. The tenant must notify the landlord on Form N9 at least 28 days before the end of a weekly rental period.

4.If you have any questions about the law related to rent increases and how it applies to this notice, you may contact the Landlord and Tenant Board at 416-645-8080 or toll-free at 1-888-332-3234. Or, you may visit the Board's website at sjto.ca/LTB for further information.
