Bill of sale is not required for an ordinary Idaho vehicle sale, since the title itself is enough to prove ownership.[1] If the seller cannot produce a properly released title, though, Idaho accepts a bill of sale as a substitute. That alternate application must be either notarized or witnessed by an assessor or deputy assessor, or the county will not process it.[2]
You do not have to use Idaho's official form either. A handwritten bill of sale is valid as long as it lists the details Idaho requires.[3] The state also accepts a bill of sale from the registrant in place of a certificate of registration, when the vehicle came from a state, province, or country that does not title vehicles.[3]

The Idaho DMV office offers Form ITD-3738 for vehicle transactions. You can also use a handwritten or customized bill of sale if you prefer, as long as it lists the details Idaho requires. Here are the steps to fill out the form, in the order the form itself uses:
Step 1: Enter the transaction date
Fill in the date at the top of the form on which you and the buyer are completing the bill of sale.
Step 2: Fill in the seller's information
Enter the following about the seller:

Enter the same details for the buyer: full legal name, street address, city, state, zip code, phone number, and email.
Step 4: Describe the motor vehicle
List the vehicle's make, model, body style, year, color, odometer reading, and VIN. The seller's and buyer's names are entered again in this section to confirm the vehicle matches this sale.
Idaho requires an odometer disclosure for vehicles newer than 2010 that weigh less than 16,000 pounds, so double-check this figure against the dashboard before signing.[1]
Step 5: Complete the purchase date, price, and method
Enter the purchase date and total price, then check how the buyer is paying: all at once, a trade-in with the traded vehicle described, a deposit with a balance due date, or a gift. Check the payment form used (cash, check, cashier's check, or money order), and mark whether the price includes tax.
Step 6: Review the miscellaneous provisions
Read the seller's ownership and no-liens confirmation, plus the as-is and entire-agreement language, before either party signs.
Step 7: Sign in the signatures section
The seller and buyer each sign, date, and print their name. If you are using a witness instead of a notary, the witness signs, dates, and prints their name on the same page.
Step 8: Complete the acknowledgment before a notary (if required)
When notarization applies, sign again in front of a notary, who fills in the county, the date, and their own certification and seal on this page.
Common mix-up: Idaho does not require every bill of sale to be notarized. Notarization, or witnessing by an assessor or deputy assessor, is required only for the alternate process used when a properly released title is not available. For an ordinary sale with the title in hand, neither is required.[2]
Motor vehicle registration laws in Idaho require titling before duly registering a vehicle. It is also possible to title and register a vehicle on the same day, though titling should precede registration.

The bill of sale should also include an odometer reading that proves the vehicle's actual mileage, or a note that the vehicle lacks an odometer and whether its mileage exceeds mechanical limits. It should also show that the seller agreed to sell the vehicle on a specific date for a specific price.
If the vehicle has a lienholder, though, Idaho requires that lienholder's name and address to appear in the new-lienholder section of the certificate of title, not on the bill of sale itself.[1]
Idaho requires the release of liability filing to be paid by the seller or transferor, not the buyer: the seller must file a release of liability with the Idaho Transportation Department within 5 days of delivering the vehicle.[1] The seller's signature also confirms they understand that giving false details on the bill of sale can carry felony penalties, so truthfulness matters when filling out this document.
The buyer should sign knowing that Idaho requires applying for the vehicle's title within 30 days of the purchase, or risk a penalty for late application.
