What you need to complete the form
Gather the following information before you begin filling out the ALA FL-035:
- Full legal names of the petitioner and respondent as they appear on the original filing
- Attorney names, addresses, phone numbers, and State Bar numbers for any represented party
- The Alameda County Superior Court case number
- The current scheduled hearing date and the proposed new date (confirmed with the court clerk)
- The type of proceeding being continued: hearing, status conference, or case resolution conference
- Details of any temporary orders currently in effect in the case
How to fill out the ALA FL-035
Step 1: Enter case information. Write the Alameda County Superior Court case number at the top of the form. Add the names of the petitioner and respondent exactly as they appear on the original court filing.
Step 2: Identify the parties and attorneys. Fill in the name, address, and phone number for each party or their legal representative. If an attorney represents a party, include the State Bar number in the space provided.
Step 3: Describe the continuance request. Indicate the type of hearing or conference being continued. Enter the current scheduled date, then add the proposed new date. You must confirm this new date with the court clerk before writing it on the form.
Step 4: Address temporary orders. If the court has issued temporary orders in the case, indicate whether those orders should remain in effect during the continuance period. This section is especially important when the case involves orders issued under the Domestic Violence Prevention Act.
Step 5: Collect all signatures. Every party or their attorney must sign the form. The court will not approve the continuance without signatures from all parties involved in the case.
Step 6: File the completed form. Submit the signed ALA FL-035 to the Alameda County Superior Court clerk's office. The clerk will confirm the new date and issue the official order for the continuance. Keep a copy for your own records.
