When to complete a Statutory Declaration

This Declaration is completed when original documents are not available or to confirm that the name on your documents and birth certificate are in fact the same person.

If you have changed your name from the name you were given at birth to the name you are using now, and you do not have documentation to show this change, you may swear a Statutory Declaration.

Sometimes the name a person uses, and has always used is different or is spelled differently than the name shown on the birth document. In some cases, women who have changed their name through marriage, divorce, and remarriage do not always have copies of marriage certificates.

If this is the case, you can support your proof of age documents by swearing a Statutory Declaration before a Commissioner for Oaths* (in any province/ territory in Canada) or a Notary Public. Alberta Pensions Services Corporation (APS), SFPP’s pension administrator, offers this service to you free of charge.

Here is a sample of what might be written in a Statutory Declaration:

I solemnly declare as follows:

“I was born on February 29, 1940 and was named Roseanne Briars although I have always been known as Rose. I married and became Rose Bush. I divorced and later remarried and became Rose Thorne. I declare that Roseanne Briars, Rose Bush and Rose Thorne are one and the same person.”

Instructions for completing the Statutory Declaration

1.You can either handwrite your declaration or have it typed into the blank spaces of this form. It needs to be properly signed and documented by a Commissioner for Oaths in order to be valid.

2.This form cannot be used in place of a Divorce Certificate to declare that a divorce has been completed.

3.Any changes/corrections to this form must be initialed by both the declarant and the Commissioner for Oaths. In the event that modifications become necessary after the form has been signed and documented, the Commissioner for Oaths will need to re-sign and date the form.

*A Notary Public or official authorized under law to complete a Statutory Declaration for any specific Province or Territory can be substituted for the Commissioner for Oaths. Please confirm with APS to verify that the official used is an acceptable signing authority.
