Who must sign the form? Both the mother and the father must sign it voluntarily. A hospital representative, local registrar, or child support agency official witnesses the signing.
What happens after signing? The father's name is added to the child's birth certificate, establishing a legal parent-child relationship with rights to custody, visitation, and child support under California law. Can the declaration be rescinded? Yes. Either parent may rescind within 60 days of signing by submitting a rescission form to the same agency. After 60 days, only a court order can set aside the declaration. Consulting a family law attorney before that deadline is strongly advised.
