FL-115: California Proof of Service of Summons (Family Law-Uniform Parentage-Custody and Support)

Enter the COUNTY of the Superior Court of California, the PETITIONER, the RESPONDENT and the CASE NUMBER.

On page 2, enter the PETITIONER, the RESPONDENT and the CASE NUMBER.

At the time of service, the person who served papers was at least 18 years of age and not a party to this action. Check a if the respondent was served with copies of the Family Law: Petition-Marriage/Domestic Partnership, Summons, and blank Response-Marriage/Domestic Partnership.

Or check b for Uniform Parentage: Petition to Determine Parental Relationship, Summons, and blank Response to Petition to Determine Parental Relationship.

Or check c for Custody and Support: Petition for Custody and Support of Minor Children, Summons, and blank Response to Petition for Custody and Support of Minor Children.

Check d(1) for the completed and blank Declaration Under Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA).

Check (2) for the completed and blank Declaration of Disclosure and (3) for the completed and blank Schedule of Assets and Debts.

Check (4) for the completed and blank Income and Expense Declaration.

Check (5) for the completed and blank Financial Statement (Simplified).

Check (6) for the completed and blank Property Declaration, (7) for the Request for Order and blank Responsive Declaration to Request for Order, or (8) for Other and specify.

Enter the address where the respondent was served.

Check the proper boxes for the means by which the respondent was served.

Check a if the copies were personally delivered to the respondent (Code Civ. Proc., § 415.10), and enter the date and the time.

Check b for substituted service: enter the name of whom the copies were left with or in the presence of, and specify title or relationship to respondent.

Check (1) for a person at least 18 years of age who was apparently in charge at the office or usual place of business of the respondent, who was informed of the general nature of the papers.

Or check (2) for a competent member of the household (at least 18 years of age) at the home of the respondent, who was informed of the general nature of the papers, on the date and at the time entered.

Then mail additional copies (by first class, postage prepaid) to the respondent at the place where the copies were left (Code Civ. Proc., § 415.20b) and enter the date the copies were mailed.

A declaration of diligence is attached, stating the actions taken to first attempt personal service.

Check 3c for mail and acknowledgment service: mail the copies to the respondent, addressed as shown in 2, by first-class mail, postage prepaid, and enter the date and the city.

Check (1) for two copies of the Notice and Acknowledgment of Receipt (form FL-117) and a postage-paid return envelope addressed to me; attach the completed Notice and Acknowledgment of Receipt (form FL-117) (Code Civ. Proc., § 415.30).

Or check (2) for an address outside California (by registered or certified mail with return receipt requested); attach the signed return receipt or other evidence of actual delivery to the respondent (Code Civ. Proc., §§ 415.40, 417.20).

Check d for Other and specify the code section; check Continued on Attachment 3d if it continues.

Enter the Name, Address and Telephone number of the person who served papers.

This person is a. exempt from registration under Business and Professions Code section 22350(b), b. not a registered California process server, or c. a registered California process server: an employee or an independent contractor.

For c, enter (1) the Registration no., (2) the County and (3) the fee for service (specify).

Check 5: "I declare under penalty of perjury under the laws of the State of California that the foregoing is true and correct."

Or check 6 if you are a California sheriff, marshal, or constable: "I certify that the foregoing is true and correct."
