What it is: This is the Statement of Vehicle Owner Who Does Not Have a Valid Title. The vehicle may never be titled again; it must be dismantled or scrapped.

The owner, the vehicle and the owner's signature
I certify that I am the owner of the vehicle described below and that: (1) I purchased the vehicle from the titled owner and I never titled the vehicle in my own name; or (2) I was issued a title in my name but the title was lost or stolen. I certify that the vehicle is worth $1250 or less and is at least eight model years old. I know that this statement will be filed with the New York State Department of Motor Vehicles (NYS DMV) and I certify that all of the information contained herein is true to the best of my knowledge. Knowingly making a false written statement is a misdemeanor pursuant to Section 210.45 of the Penal Law.
Enter the Year, Make, Model, VIN and Color.
Common mistake: Enter the Vehicle Owner Name, the Government Issued ID No. of Owner and the Address of Vehicle Owner. A copy of the identification must be attached.
Sign on the Owner Signature line and enter the Date.
Delivery agent information and certification
The delivery agent's certification: I know this statement will be filed with the NYS DMV and I certify that all the information contained herein is true to the best of my knowledge. Knowingly making a false written statement is a misdemeanor pursuant to Section 210.45 of the Penal Law.
Enter the Driver Name, the name of the delivery agent.
Common mistake: Enter the DOB and the Government Issued ID No. of Delivery Agent. A copy of the identification must be attached.
Enter the Plate on Delivery Vehicle and the Date.
The delivery agent signs on the Signature of Delivery Agent line.
Dismantler, itinerant vehicle collector, or scrap processor information and certification
The dismantler's, itinerant vehicle collector's or scrap processor's certification: I certify that I paid $1250 or less for the vehicle described above. I certify that there are no undisclosed liens against this vehicle. I know that the business noted below will file this statement with the NYS DMV. Knowingly making a false written statement is a misdemeanor pursuant to Section 210.45 of the Penal Law.
Enter the Business Name and the Business ID No.
In the business's part, enter the Name and the Title, sign on the Signature line and enter the Date.

Tow truck drivers, IVCs, dismantlers and scrap processors
You are a vehicle dismantler or IVC
If the title document is not available, make a copy of the owner AND delivery agent's government-issued identification. Attach the title or photocopies of identifications to this form. Also attach copy 2 of the form MV-907A (Salvage Certificate). Write “For Parts Only” on the front of the MV-907A.
You are a scrap processor
If the title document is not available, make a copy of the owner AND delivery agent's government-issued identification. Attach the title or photocopies of identifications to this form.
You are a tow truck driver who delivers vehicles for scrap
Tow truck drivers cannot claim ownership of vehicles being delivered for scrap via the MV-35. The individual or entity they acquired the vehicle from is the owner. The tow truck driver is only the delivery agent. (NYS Vehicle & Traffic Law - Section 429-1(b))
Any tow truck drivers engaged in the business of acquiring inoperable vehicles for scrap are required to be registered as Itinerant Vehicle Collectors (IVC) or vehicle dismantlers.
You are a registered IVC, a vehicle dismantler or a scrap processor
Registered IVCs are required to issue a “Salvage Certificate for a 1973 or Newer Vehicle” (MV-907A) for all vehicles they deliver to vehicle dismantlers or scrap processors.
Vehicle dismantlers and scrap processors should not accept vehicles from IVCs unless it is via a MV-907A.

Is there a deadline?
For the dismantler, itinerant vehicle collector or scrap processor: Within 15 business days after acquiring the vehicle, send the completed forms.
Where do I file it?
For the dismantler, itinerant vehicle collector or scrap processor: Completed forms to: NYS DMV Junk and Salvage, PO BOX 2105, Albany, NY 12220-0105. When registered IVCs deliver vehicles to vehicle dismantlers or scrap processors, the completed MV-35 should be attached to the DMV copy of the MV-907A (the “Salvage Certificate for a 1973 or Newer Vehicle”) as ownership documentation.
When is this form not the right one?
Only a vehicle owner who has not obtained a title in the owner's name, or has lost the title in the owner's name, may use this statement, and only to transfer the vehicle described on it to a registered vehicle dismantler, an itinerant vehicle collector (IVC) or a certified scrap processor. The vehicle being transferred must be worth $1250 or less and be at least eight model years old. This statement may not be used to transfer ownership to a private party or entities not licensed by DMV such as tow truck drivers or charitable organizations. An entity engaged in the business of vehicle acquisition for the purposes of dismantling or disposal may not use this form to allege ownership and transfer a vehicle.
