VA Form 10-0137 (MAR 2024), VA Advance Directive: Durable Power of Attorney for Health Care and Living Will, is the Department of Veterans Affairs form for recording health care preferences in case you can no longer make decisions for yourself. Part I collects personal information. Part II, the Durable Power of Attorney for Health Care, lets you appoint a Health Care Agent and an alternate. Part III, the Living Will, records whether you would want life-sustaining treatments such as CPR, a breathing machine, kidney dialysis or a feeding tube in the situations listed, with optional mental health and additional preferences. In Part IV you sign and two witnesses sign; a witness may not be your Health Care Agent, a beneficiary of your estate or financially responsible for your care. Part V is an optional notary section: the form is valid in VA facilities without notarization but may need it to be legally binding outside VA health care.
