Other Arkansas Forms
An Arkansas durable, limited or general power of attorney must be signed by the principal, or by another individual who signs the principal's name at the principal's direction and in the principal's conscious presence. On a durable, limited or general power of attorney, the principal's signature is presumed to be genuine if the principal acknowledges it before a notary public or another individual authorized by law to take acknowledgments.[1]
Unless the document says otherwise, an agent under a durable, limited or general power of attorney accepts the appointment by exercising authority or performing duties as an agent, or by any other assertion or conduct that shows acceptance.[2]
