In order to be compliant with the National Environmental Policy Act (NEPA), Federal agencies are required to complete an Environmental Assessment (EA) or a more comprehensive Environmental Impact Statement (EIS) for any “significant” actions they propose. What constitutes a significant action, however, is not always clear. To help Federal agencies make that determination, the Council on Environmental Quality (CEQ) has issued guidance in the form of its NEPA regulations and Circular A-16. In this post, we will explore CEQ’s definition of significant and offer tips on how to determine if an action is significant enough to warrant compliance with NEPA.
