Form 3940 (Revised 03/2026), the Paternity Acknowledgment of the Georgia Department of Public Health, is the voluntary agreement by which the mother and the biological father add the father's name to the child's birth record; the child's name may be changed on the same form within the first year. It cannot be used if the mother was married to anyone within the 10 months before the birth or if another father is listed on the birth certificate. Its six sections are the State Office of Vital Records' block, the child's and parents' information, the mother's information and signature, the mother's notary, the father's information and signature, and the father's notary. It must be notarized and filed with the State Office of Vital Records within 30 days; either parent may rescind within 60 days of signing. Paternity alone gives no custody, visitation or inheritance rights, which need a petition for legitimation with the court.
