•Thisnoticeisrequiredtobeserved,bytheowner,onthefirsttenantofthehousingaccomodationafterthe unitbecomesexempt/deregulatedfromtherentlaws. AlthoughthisformispromulgatedbyDHCR,the regulationsdonotrequireDHCRtoreviewtheaccuracyofthecontentsofthecompletedformandthe formisnotrequiredtobeservedonDHCR. However,DHCRonitsowninitiativemayconductauditsof thesenotices.
•Thisnoticeisrequiredtobesentbycertifiedmailtothetenant,within30daysafterthetenancy commencedorafterthesigningoftheleasebybothparties,whicheveroccursfirst,orshallbedelivered tothetenantatthesigningofthelease.
•Inaddition,theownershallsendandcertifytothetenantacopyofaregistrationstatementforsuch housingaccomodationfiledwithDHCRindicatingtheexempt/deregulatedstatusandthelastlegalregulated rent. Itshallbesentwithin30daysafterthetenancycommencesorthefilingofsaidregistration,whichever occurslater.
