Affirmation Legal Work Status Form PDF Details

The Affirmation of Legal Work Status form is required under Colorado's Employment Verification Law (§ 8-2-122, C.R.S.) for all public and private employers in the state. Enacted on January 1, 2007, this law requires every employer to affirm the legal work status of each employee hired on or after that date.

Who must complete this form: All Colorado employers, regardless of size or industry, must submit an Affirmation of Legal Work Status for each new hire. This includes both public agencies and private businesses. Staffing agencies and contractors also bear responsibility for their placed workers.

Filing deadline: Employers must complete and retain the affirmation within 20 calendar days of a new employee's start date. The signed form must be kept on file and be available for inspection by the Colorado Department of Labor and Employment (CDLE).

Acceptable verification documents: Employers may use a Colorado driver's license, a U.S. passport, a Permanent Resident Card (Green Card), an Employment Authorization Document, or other documents listed on the federal Form I-9. The employment verification form package can supplement this documentation.

Penalties for non-compliance: Failure to file or retain the affirmation can result in fines under state law. Repeated violations may lead to suspension of business licenses. Employers should also retain records alongside their other employment forms for at least three years after the hire date.

This form works alongside federal Form I-9 requirements. For related state documentation, see the Additional Work Authorization form.
