Who Must Submit the BCIA 8302 Form

The BCIA 8302 form applies to California agencies outside the Department of Justice that submit applicant fingerprints for employment or licensing background checks. Under California Penal Code section 11105.2(d), these agencies must notify the Bureau of Criminal Information and Analysis when any of these situations occur:

• An applicant is not hired after a background check is completed
• An employee's or volunteer's service ends after initial DOJ approval
• An agency withdraws its interest in an applicant for any reason

What Information the BCIA 8302 Form Requires

A valid NLI notification must include two categories of information:

• Applicant details: full name, date of birth, and the type of application filed
• Agency details: agency name, ORI number (Originating Agency Identifier), mailing address, and the name of the contact person

The ORI is a unique code assigned to each California agency by the DOJ. The BCIA cannot process a notification without a valid ORI on file.

Submission Process and Compliance

After filling out the form, submit it to the California Department of Justice, Bureau of Criminal Information and Analysis. Prompt submission keeps the state criminal records database accurate. Agencies that fail to submit the notification may face compliance issues under the California Penal Code.
