The CH-115 form, also called the Request to Continue Court Hearing, is a mandatory form in civil harassment prevention cases. It is governed by California Code of Civil Procedure Section 527.6(p). The form was revised as of January 1, 2020.
Both the protected party and the restrained party may file this form to postpone a hearing from the Civil Harassment Restraining Order process. The person filing must explain why the original court date cannot be kept. Common reasons include needing more time to serve the other party, hiring an attorney, or gathering evidence.
While the hearing is postponed, any Temporary Restraining Order in effect stays active. The court notifies all parties of the new hearing date once the request is approved. For an overview of related forms, see the Civil Harassment Packet.
