The Standard Commercial Production Agreement (Revised 12/17/07) is a contract between a contracting client (the advertiser or its agency) and a production company for producing commercials. Page 1 records the parties and job numbers, then: A. commercial identification (titles and lengths); B. designated personnel, such as the director and executive producer; C. production requirements, with reference to the bid estimate and Addendum A; D. terms of payment, with the contract price and the share due at signing, at approval of photography and on delivery; E. editorial, with four options for who performs and pays for editing; and F. signatures. The terms on page 2 cover quality, ownership, security and confidentiality, independent contractor status, audit rights, producer and client warranties, delivery of materials, payment, indemnification, tax liability, insurance, contingency and weather days, cancellation and postponement, publicity, dispute resolution and applicable law.
