What Is a Montana Power of Attorney?

A power of attorney is a signed form in which you, the principal, give another person, your agent, the legal authority to act on your behalf. Your agent can pay bills, manage financial assets, handle business matters, deal with a government office or speak with your doctors, depending on the powers you list.

Many Montanans use one to plan ahead for illness, disability or travel. Each form below is built for one kind of task, so the first step is to know what you need done.

PrincipalThe person who gives the powers, such as Anna Baker of 123 Main Street, Helena
AgentThe person who receives the powers, such as Daniel Cole
FormThe signed paper that lists the powers and when they start

How to Sign a Montana Power of Attorney

A Montana durable, limited or general power of attorney must be signed by the principal, or in the principal's conscious presence by another individual directed by the principal to sign the principal's name on it. On a Montana durable, limited or general power of attorney, the principal's signature is presumed to be genuine if the principal acknowledges it before a notary public or another individual authorized to take acknowledgments.[1]

Follow these steps to put your form in place:

  1. Choose the power of attorney form that matches your task.
  2. Fill in the names of the principal, which is you, and of the agent, and list the powers you give. For example, principal Anna Baker of 123 Main Street, Helena, names agent Daniel Cole.
  3. Download the PDF template and fill it in with the PDF editor, or build the form online.
  4. Read the whole form once more, including any instructions, then sign it the way its entry above describes.
  5. Give your agent a copy and keep the original in a safe place.

Choosing Your Agent

Your agent acts for you, so choose with care. Talk with the person first, so the role does not come as a surprise. Then ask yourself three questions about the person you have in mind:

  • Do I trust this person with my affairs?
  • Will this person be easy to reach when I need help?
  • Does this person know what I want?
Keep the signed original in a safe place and give your agent a copy. Banks, doctors and government offices often ask to see the legal documents, so keep them where they are easy to find.

Common Mistakes to Avoid

Most problems with a power of attorney come from small slips, not from the form itself. A few minutes of care now can save your family time and stress later. Watch for these mistakes before you put your name on a form:

  • Using a form that does not match the task, such as a financial form for a health care decision.
  • Leaving blank fields in the part that lists the powers you grant.
  • Picking someone without talking to that person first.
  • Putting your name on a form before you read all of it.
  • Storing the original where no one can find it.
