Colorado Motorcycle Bill of Sale Requirements

The state says a bill of sale is best practice for a vehicle sale and is required if the sale price is not listed on the title. If the title is completed correctly, a bill of sale is not needed for the title transfer.^[1.2] A written bill of sale still gives both sides proof of the deal.

Form DR 2173 points to four things a motorcycle bill of sale should show:

• The seller. Use the seller's full name. A first initial and last name is not acceptable for the seller or the seller's agent.
• The motorcycle. Give a vehicle description with the year, make and VIN.
• The sale. Enter the purchase price and the day of sale.
• The signature. The bill of sale needs a signature. The form also covers the case where the original title was not signed by the owner listed on the title.^[1.1]

Titling and Registering the Motorcycle

After the sale, the buyer titles and registers the motorcycle in their name. Buyers have 60 days from the date of purchase to do it, and C.R.S. § 42-3-103(1)(a) requires every owner to register the vehicle within that time.^[3.1] To start the transfer, the seller provides the properly endorsed Colorado certificate of title.^[1.1]

If a lienholder has a lien on the motorcycle, the lien must be released. Form DR 2173 asks for the date the lien was released.^[1.1]

In practice, many buyers bring these items to the motor vehicle office:

• The endorsed title
• Photo identification
• Proof of insurance
• A signed copy of the bill of sale

Declaration Under Penalty of Perjury

Colorado's transfer law has the owner named on the title affirm the sale in a written declaration under the penalties of perjury in the second degree.^[2] The owner's agent or attorney can make the declaration instead. The statute's own wording is quoted below.

The person in whose name the certificate of title is registered or the person's agent or attorney shall affirm the sale or transfer, accompanied by a written declaration that the statement is made under the penalties of perjury in the second degree, as defined in section 18-8-503, c.r.s.

In plain words, the owner confirms the sale in writing under penalties of perjury.

How to Fill Out a Colorado Motorcycle Bill of Sale

1. Date. Write the day you make the bill of sale on the DATE line at the top of page 1.

   

2. Seller's information. Complete the Seller block with the seller's contact details: street address, city, state, zip code, phone number and email.

   

3. Buyer's information. Complete this block with the contact details: street address, city, state, zip code, phone number and email.

   

4. Names in the agreement. Repeat both names in the opening sentence of Section 3, where the form shows (Seller's name) and (Buyer's name).

   

5. Motorcycle details. Enter the make, model, year, odometer reading in miles, color and VIN of the motorcycle being sold.

   

6. Purchase date and total price. On page 2, enter the day of purchase and the total price in U.S. dollars.

   

7. How the price is paid. Initial the box for the payment arrangement that applies, such as all at once or trade-in. For a trade-in, also enter the contemporaneous payment, if any, in dollars.

   

8. Trade-in make and model. If the buyer trades in a vehicle, enter its make and model under Buyer's vehicle. Skip this if you did not choose the trade-in box.

   

9. Trade-in year and odometer. For the trade-in, enter the year and the odometer reading in miles.

   

10. Trade-in color and VIN, deposit or gift. For the trade-in, enter the color and VIN. For a deposit, initial that box and enter the deposit amount, when the deposit was paid and when the balance is paid in full. Initial the gift box if the motorcycle is given with no payment.

    

11. Payment type. Select one payment type by initialing its box. For a check, enter the check number.

    

12. Taxes. Initial one box. Either all applicable taxes are included in the purchase price, or taxes are not included.

    

13. Signatures. On page 3, the seller and the buyer each sign, print their name and enter the date. The form also has two witness lines, each with a signature, printed name and date.

    

14. Acknowledgment: county, date and names. Page 4 is the notary acknowledgment. If you have the bill of sale notarized, sign before the notary or other officer, who completes the county, the date, the officer's name and title, and the name of the person who appeared.

    

15. Acknowledgment: officer's signature and seal. The officer signs on the Signature line and adds the seal where the form shows (seal).

    

Section 5 of the form has no fields to fill in. Read it before you sign. In it:

• The seller confirms they own the motorcycle, have the right to sell it, and that it has no liens or encumbrances.
• The motorcycle is sold "as is," with no express or implied guarantees or warranties.
• The buyer accepts all liability for the motorcycle as of the date of sale.
