The California Motion Form MC-051, officially titled the Notice of Motion and Motion to Be Relieved as Counsel, is a mandatory Judicial Council of California document that gives an attorney a formal way to ask the court to approve withdrawal from a civil case. Under California Code of Civil Procedure section 284(2), an attorney cannot simply stop representing a client without written client consent or a court order. The MC-051 form initiates the court order process when the parties cannot agree on withdrawal.

Attorneys typically file MC-051 when a serious breakdown in the attorney-client relationship occurs, when a client fails to pay required legal fees, or when continued representation would create an ethical conflict. Once filed, the form must be served on the client and all other parties in the case by personal delivery, certified mail, or another method approved under California Rules of Court, rule 3.1362.

The form contains two key sections. The Notice of Motion section lists the hearing date, time, department, and court address where the judge will consider the request. The Notice to Client section explains what will happen if the motion is granted, including the requirement that the client find new legal representation or proceed as a self-represented party. The form also identifies the client by role, such as plaintiff, defendant, guardian, conservator, or personal representative.

At the scheduled hearing, the judge reviews the motion and the circumstances that led to the withdrawal request. If the court grants the motion, the attorney is formally relieved of all remaining duties in the case. Cases with imminent trial dates may face additional scrutiny, and the court may require the attorney to demonstrate that the client has had sufficient time to retain new counsel before approving the withdrawal.
