Maine Laws and Lease Requirements

Security Deposit Requirements

In Maine, the law restricts the maximum security deposit a landlord can request to no more than two months’ rent (Maine Revised Statutes, Section 14-6032). This cap protects tenants from excessively high upfront costs when renting a property.

Upon the lease’s termination, the landlord must return the security deposit within a specific timeframe. For standard leases, this period is up to thirty days post-lease expiration. However, for tenancies at will, the period is shortened to twenty-one days (Section 14-6033).

Maine Revised Statutes, Section 6025 outlines specific rules for landlord entry into rented properties. If a tenant reports a potential infestation, the landlord has a brief window to investigate and address the issue, ensuring the tenant’s living environment remains pest-free (Section 14-6021-A).
  • Utilities in common areas. Landlords cannot charge a single tenant for utilities in common areas unless all tenants share the cost or the tenant paying receives a corresponding rent reduction (Section 14-6024).
  • Lead-based paint. For properties built before 1978, landlords must disclose potential exposure to lead-based paint and provide educational materials about its risks. Notification is also required before renovations that might increase lead exposure (Section 14-6030-B).
  • Energy efficiency. Tenants are entitled to a report detailing the property’s energy costs for the previous twelve months, which helps them understand potential utility expenses before signing the lease (Section 14-6030-C).
  • Radon testing. Landlords must test the air for radon in leased residential buildings every ten years unless a mitigation system is installed. New constructions require testing within the first year of occupancy. If radon is detected, tenants can terminate their lease with thirty days’ notice (Section 14-6030-D).
  • Smoking policy. Landlords must communicate the premises’ smoking policy, delineate areas where smoking is allowed or prohibited, and provide this information in writing at the time of lease signing (Section 14-6030-E).
