Arkansas Laws and Lease Requirements

The Arkansas Code, Chapter 16 and Chapter 17 include requirements and regulations that landlords and tenants must follow to ensure a legal and fair rental process.

Requirements for Security Deposit

In Arkansas, landlords who manage six or more rental units are subject to specific regulations regarding the collection of security deposits. The state caps the maximum amount a landlord can charge for a security deposit at two months’ rent, as stipulated by § 18-16-304 of the Arkansas Code.

Landlords must return the tenant’s security deposit within 60 days after the lease ends. This return should include the full amount of the deposit minus any legitimate deductions for unpaid rent or damages caused by the tenant beyond normal wear and tear. If the landlord cannot locate the tenant to return the deposit and remains uncontactable for up to 180 days, the landlord may retain the deposit as stated in § 18-16-305.

Landlord’s Right of Entry

Arkansas has no specific state law mandating landlords to provide advance notice before entering a rented property. However, it is widely recommended and considered best practice for landlords to give at least 24 hours notice before entering a tenant’s residence. This courtesy helps maintain a good relationship between the landlord and tenant, respecting the tenant’s privacy and convenience.

Landlords typically use the right of entry to perform necessary repairs or maintenance, inspect the property for compliance with the lease terms, or show the property to prospective tenants or buyers.

Payment and Fees

In Arkansas, tenants must pay rent on the date specified in the lease agreement, as outlined by § 18-17-401. If needed, the law permits a 5-day grace period for rent payments according to § 18-17-701. This provision allows tenants some flexibility in case unforeseen circumstances may delay payment.

Mandatory Disclosures

42 U.S. Code § 4852d requires landlords to inform tenants of the potential presence of lead-based paint in rental properties built before 1978. The disclosure must include any known information concerning the presence of lead-based paint and must be accompanied by an EPA-approved pamphlet that provides additional information about the risks of lead paint. Landlords must also provide tenants with records or reports on lead or lead-based paint hazards.
