Medical power of attorney in Kentucky is also referred to as a Living Will Directive. This document designates an individual who will decide what treatment and medical procedures you will take if you cannot decide this on your own (for instance, due to a coma). Kentucky law requires an advance directive to be in writing, dated and signed by you, and either witnessed by two or more adults or acknowledged before a notary public.[3]

General power of attorney is a form you can sign if you need to allow other people to manage your funds and estate. Under Kentucky law, a power of attorney is durable unless it expressly says that your incapacity ends it, so your agent's authority continues if you later become incapacitated.[4]

Unless the power of attorney says otherwise, a person named as agent in a Kentucky durable, limited or general power of attorney accepts by exercising authority, performing duties as an agent, or any other assertion or conduct indicating acceptance.[2]
