The APP-009 Proof of Service is a California Judicial Council form required in Court of Appeal proceedings. It certifies that legal documents were delivered to all required parties, either by mail or in person. The person completing this form must be at least 18 years old and cannot be a party to the case.
The person serving the documents, called the "server," fills out and signs the form under penalty of perjury. Attorneys, legal assistants, and any qualified third party who physically mailed or delivered the court documents can act as server. Parties to the case are not eligible to serve documents under California court rules.
Use this form (APP-009) only for service by mail or personal delivery. For electronic service, California courts require form APP-009E. Using the wrong form can result in document rejection and require re-service. Always confirm the required service method with the Court of Appeal before completing either form.
You must include the case name, Court of Appeal case number, and Superior Court case number. For each person served, list their name, address, method of service, and the exact date and time. For mail service, record the date the envelope was placed for mailing and the destination address.
Do not leave the case number blank and do not use this form for electronic service. Failing to record the exact time of personal delivery is another frequent error. If multiple people need to be served, each must be listed individually. The server must sign the declaration before the form can be filed with the court.
