In Maine, the power must be in writing and signed by the principal and 2 witnesses. Signatures of the principal and witnesses must be made in person and not by electronic means.[3] An adult or emancipated minor with capacity may execute a power of attorney for health care, which is the name Maine law gives this document.[1]

The electronic signature rule in section 5-803 reads:
Notwithstanding any law validating electronic or digital signatures, signatures of the principal and witnesses must be made in person and not by electronic means.

Under Maine law, an agent named in your advance health care directive can serve as your personal representative for all purposes of the federal Health Insurance Portability and Accountability Act of 1996 (HIPAA).[3]
Maine's statutory advance health care directive form, in section 5-805 of Title 18-C, has optional spaces for a first alternate agent and a second alternate agent. The first alternate acts if you revoke your agent's authority, or if your agent is not willing, able or reasonably available to make a health care decision for you. The second alternate acts if you revoke the authority of both your agent and your first alternate, or if neither is willing, able or reasonably available.[4]
