In Colorado, the Medical Durable Power of Attorney form (or the MDPOA form) is one of the documents that are parts of the Advance Directive.

In the MPA form, you will leave special instructions that depend on your will. These instructions may tell about:

And other things tied to your health care in critical conditions.

Every state in the US has different rules and laws regarding the MPA form. In some states, you will need to notarize the form. Others ask for a witness or two witnesses to make the form valid.

Colorado Laws and Requirements

In Colorado, the basic information about the MDPOA form is stated in section 15-14-506 of Colorado Statute. Notarizing and witnessing the MDPOA form is optional in this state.

The MDPOA form is brief and will not take long to complete: it is a one-page form that requires the presence of only a declarant. He is the one who signs the MDPOA form: there is no need to sign for the agent (attorney).

In Colorado, you (as a declarant) may add three agents in your MDPOA form. Do not forget to state the type of relationship that connects you with your agent (or agents).

5. Fill out the Instructions for Your Agent

In the second section of the MDPOA form, you should leave the instructions for your Agent. They may include all the information about your will regarding your health conditions and medical care, including life-sustaining procedures, treatment, and other aspects.

In these lines, you may also add some instructions that can limit or increase the responsibilities of your agent.

This section is optional: you may leave it blank if you fully trust your agent or have transferred the instructions in any other way.

6. Sign the MDPOA Form

Below the “Instructions” section, you have to sign the MDPOA form and put a date of signing.

Pay attention to the additional text below your signature: by signing the existing MDPOA form, you annul all the previous MDPOA forms you had signed before.

7. Ask Witness (or Witnesses) to Sign (If Needed)

Keep in mind that the MDPOA form in Colorado does not require witnesses’ signing or notarizing. However, if you need so, the form has blank lines for the details and signatures of two witnesses.

8. Ask a Notary to Sign (If Needed)
