Medical Power of Attorney in Maryland: Free Form

What Does Maryland Law Require for a Medical Power of Attorney?

Maryland sets its signing rules for advance directives in Section 5-602 of the Md. Code, Health-Gen. The document must be dated and signed by the declarant, or by another person at the declarant’s express direction. It must also be subscribed by two witnesses in the declarant’s physical or electronic presence.^[1]

The declarant is the person making the document, also called the principal.

A written or electronic advance directive shall be dated, signed by or at the express direction of the declarant, and subscribed by two witnesses in the physical presence or electronic presence of the declarant.

• Date: The document must be dated.
• Signature: You sign it, or another person signs at your express direction. State law sets the conditions for a signature by another person.
• Witnesses: Two witnesses sign in your physical or electronic presence. Your health care agent may not serve as a witness.^[1]

Notarization is not required. The statutory advance directive form in section 5-603 of the Md. Code, Health-Gen. states that Maryland law does not require the document to be notarized.^[2]

What the Maryland Medical Power of Attorney Template Covers

How Is a Medical Power of Attorney Different From a Living Will?

What to Gather Before You Start

Gather a few details before you start, so you can finish in one sitting. Most of the fields ask for names and contact information, and the rest ask for dates and signatures.

• Your full name and home address.
• The name, address, phone number and email of the person you want as your agent.
• The same details for your alternate agent.
• Two witnesses who can be with you, in person or electronically, when you sign.
• A pen for the signature lines if you print the form.

Filling Out the Maryland Medical Power of Attorney Form

The fillable fields sit on pages 1, 6, 7 and 9 of the form. Page 1 takes the names and contact details of you, your agent and an alternate agent. Page 6 takes your date and signature, page 7 is the acknowledgment page, and page 9 has two witness blocks. The steps below follow the form in that order.

1. Name yourself and your agent. On page 1, under Part I, enter your name and address, then the name and address of the person you appoint as your agent.

   

2. Add contact details and an alternate agent. Still on page 1, add the agent’s phone, email and any alternative contact information. In the alternate agent paragraph, repeat the agent’s name, then enter the alternate agent’s name, address, phone, email and alternative contact.

   

3. Date, sign and print your name. On page 6, enter the date, sign on the signature line and print your name under it.

   

4. Fill in the acknowledgment. Page 7 is the acknowledgment page, set aside for a notary public or other officer. It asks for the county, the date, the officer’s name and title, and your name.

   

5. Leave the officer’s signature line to the officer. The last line of page 7 is the officer’s Signature (Seal). The notary or officer completes it, and you do not sign there.

   

6. Have both witnesses complete their blocks. On page 9, each of the two witnesses signs, prints a name, writes an address and adds the date in their own block.

   

How to Sign and Use the Maryland Medical Power of Attorney

Filling in the form is only part of the job. After your entries are complete, you still need to sign it and collect the witness signatures. These steps cover what to do before and after the form itself.
