Iowa Laws and Lease Requirements

Chapter 562A of the Iowa Code, known as the Uniform Residential Landlord and Tenant Law, establishes the guidelines for interactions between property owners and tenants.

Security Deposit

Under the Iowa Code, specifically Section 562A.12(1), landlords in Iowa are restricted to charging a maximum of two months’ rent for security deposits. This measure is intended to keep the security deposit within a reasonable limit, protecting tenants from exorbitant upfront costs when leasing a property. Once a tenancy concludes, landlords have a specific obligation regarding the return of the deposit.

According to Section 562A.12(3)(a), a landlord must refund the security deposit within thirty days after the lease ends, provided the tenant has a new mailing address. This prompt return helps tenants receive their deposits back on time, minus any deductions for damages that exceed normal wear and tear.

Landlord’s Right of Entry

The right of landlords to enter rental properties is also regulated under Iowa’s landlord-tenant law to ensure tenant privacy and landlord access are balanced. Section 562A.19(3) of the Iowa Code stipulates that landlords must give tenants at least twenty-four hours’ notice before entering the property, except in cases of emergency. This entry must occur during reasonable hours, primarily business hours, to minimize intrusion into tenants’ personal lives.

Mandatory Disclosures

In Iowa, a rental agreement typically includes several disclosures that both parties must agree to before finalizing the contract:

  • Contact Information. Under Section 562A.13, landlords must provide the names and addresses of all parties interested in the property, such as owners and managers, ensuring tenants know whom to contact for rental issues.
  • Environmental Notification. Notification if the property is listed in the EPA’s Comprehensive Environmental Response, Compensation, and Liability Information System, as per Section 562A.13(6).
  • Health Hazard Disclosure. Disclosure of potential health or environmental hazards, including the presence of lead-based paint, under the requirements of 42 U.S. Code § 4852d.
  • Rent and Utility Information. Details on upcoming rent increases and utility costs, according to Sections 562A.13(5) and 562A.13(4).
