The landlord can file this paper if he wants the tenant to vacate the rented premises. There are some restrictions regarding the notice. For instance, the owners of the premises can only use the form if they have a month-to-month lease agreement with a tenant.

Such documents should contain certain information, including:

  • Rented premises’ address;
  • Date when a renter should leave the premises;

The Form may contain other important details as well. The reason why the renter should leave is optional, so the owner can skip it.

The notice is called a “30-Day Notice to Vacate” because in the majority of states, by law, the renters must receive such a notice in no less than 30 days before they need to leave.

When to Use the 30-Day Notice to Vacate Form

Such forms are commonly used by owners who decide that they need their dwelling property for some other personal needs, including moving in instead of the renter, selling the property, vacating it for other people (for instance, relatives), or any other reason.

You should know that this form is not typical for cases when a renter violates the lease agreement’s rules and conditions. There are other templates for such situations, and the one you should choose depends on the type of violation. Normally, each state has its own norms and regulations regarding such notes.

Who Should Complete the 30-Day Notice to Vacate Form

Usually, either the owner of the subject premises or the legal representative shall complete and sign this document. The tenant, as the receiver of the notice, should not sign it.

However, it is crucial for the owner that the tenant is aware of the notice and has read it. So, the owner should ensure the notice’s delivery to the tenant.

Sometimes the renter is the one who wants to cancel the lease agreement. For such cases, there is another template allowing the renter to warn the owner about moving out.

Should One Notarize the Form?

Unlike many other legal forms in the US, you do not have to notarize the 30-Day Notice to Vacate form. However, to make the record valid, the person who creates the document should also sign it.

Obtain the Template

The 30-Day Notice to Vacate can only be delivered to the renter if the parties have signed the Month-to-Month Lease Agreement. You cannot use such a notice for other lease agreements.

Another condition is the lease period: the tenant must stay on the rented premises for no more than a year. Otherwise, you cannot notify the resident about leaving with such a document. If the situation fits all those conditions, proceed to the next part.

State the Facts

In the following “Facts” section, you should add the information about the lease agreement signed by both the lessor and lessee. Write the date of the contract, the place where parties have signed it (city and state), both parties’ names, and the info about the rented estate.

Set the Due Date

After describing the deal, insert the date when the renter should leave the premises. Write the landlord’s name once again.

Define the Rent Payment

Count how the payment amount the renter ought to pay to the owner. Enter the total sum and payment due date in the corresponding blank lines.

Reveal the Security Deposit

Insert the exact amount (in dollars) provided by the tenant as a security deposit.

Add the Landlord’s Information

At the end of the form, add the landlord’s (or agent’s) details: their full name and contact details (email address, phone numbers, fax, physical address).
