TERMS AND CONDITIONS OF CONTRACT

A.Hollywood Park is the trading name of O.B. HEFFER, a sole proprietor which trades from premises at 126 Intersite Avenue, Umgeni Business Park, Springfield, Durban (P.O. Box 74234, Rochdale Park, 4034) (hereinafter referred to as the Creditor").

B. The Customer whose details appear overleaf, hereby applies for a telebetting account.

1.APPLICATION

The following terms and conditions shall apply to the telebetting contract entered into between the Customer and Hollywood.

(a)The Customer by signing the application form, shall be deemed to have read and offered to Hollywood to conclude an agreement according to the conditions of use as set out herein.

(b)The residential address which the Customer furnishes on the application form will serve as his/her domicilium citandi et executandi for all purposes.

(c)The Customer must be over the age of eighteen (18) years in order to apply for a telebetting account.

(d)Hollywood reserves the right to request proof of age from the Customer prior to considering the application.

(e)This account may only be used by the Customer and is not transferable.

(f)The Customer agrees that if Hollywood deems it necessary, Hollywood is entitled to at their own discretion to perform a credit check on the credit worthiness of the Customer.

(g)Hollywood reserves the right to confirm the bet and/or reject and/or reduce the potential win on any bet.

(h)No interest will be paid on credit accounts.

(i)Hollywood reserves the right to close the account at any time and any monies owed to the Customer will be paid out immediately.

(j)In the event that the Customers account is in debit, the amount outstanding as at that time will immediately become due and payable.

(k)The Customer accepts that it is his responsibility to be aware of the General Rules and Regulations relating to horse or sport betting and bets cannot be voided.

(l)Hollywood is regulated by the KwaZulu Natal Bookmakers Control Committee located at 3 Nollsworth Crescent, Nollsworth Park, La Lucia Ridge, P.O. Box 555, Umhlanga Rocks, 4320.

(m)By law Hollywood is subject to the Financial Intelligence Centre Act and as such is bound by their rules and regulations, which the Customer accepts he is fully aware of.

(n)All calls will be recorded.

(o)Hollywood has a maximum payout per ticket of R250 000. Split bets (same bet different ticket number) will be deemed as one ticket.

2.PAYMENT

(a)The account will be operated on a deposit only basis unless credit facilities are granted to the Customer. In order for the account to be active, money needs to be deposited.

(b)A deposit of R300 is required when opening a new account.

If credit is granted Hollywood will determine the limit of such credit in its sole discretion and may vary that limit at any time.

(c)Hollywood will not be obliged to place a bet in the event that there is insufficient credit in the account.

(d)In the event that the Customers account is in debit, the amount will be payable on or before the last day of the month in which the debit was incurred.

(e)Any amount not paid by the Customer on due date shall bear interest at the rate of 2% per month.

(f)In the event that the Customer calls a bet incorrectly, Hollywood will not be responsible for any damages suffered by the Customer from any cause whatsoever.

(g)Hollywood would not be responsible for any loss of profit or any damages suffered by the Customer from any cause whatsoever either directly or indirectly, consequential or otherwise.

(h)Without derogating from the generality of the aforegoing, Hollywood will not be liable for its own negligence or the negligence of any of their agents or employees.

3.SUSPENSION OF CUSTOMERS OBLIGATIONS

If any amount owing by the Customer is not paid on due date, then without prejudice to any other right it may have, Hollywood may immediately suspend the carrying out of its then uncompleted obligation until the payment is made.

4.JURISDICTION

(a)Hollywood will be entitled to institute any proceedings against the Customer, arising out of the contract, for the full balance outstanding, in the Magistrates Court having jurisdiction over the Customer, notwithstanding that the claim or the value of the matter in dispute may exceed the jurisdiction of the Magistrates Court. Further, the Customer agrees to be liable for legal costs, including costs on the attorney and own client scale and collection charges, including tracing costs which may arise.

(b)A certificate signed by an employee of Hollywood showing the amount due and owing by the Customer to Hollywood at any given time shall be conclusive proof of the facts therein stated for the purpose of all legal proceedings against the Customer for recovery of the said amount.

5.This contract constitutes the entire contract between the parties and no representation by any person, or variations or amendments of any of the terms or conditions hereof shall be valid and binding on the Customer unless reduced to writing and signed by both parties.

6.No extension of time or any other relaxation or indulgence granted by Hollywood to the Customer shall operate as or be deemed to be a waiver by Hollywood of any of its rights under this contract or a novation or any of the terms and conditions of this contract.

7.LIMITS

No Dividend limits apply to Win, Place, Swinger, Exacta, Trifecta, Quartet, Double, Place Accumulator, Jackpot or Pick Six. Starting Price bets as well as Yankee type bets are also subject to these limits.

Payouts will be limited to the lesser of : R250 000 Ticket Limit or 250 000/1 Odds limit.

Examples:

1.) If you catch a Pic- 6 that pays R530 000,00 to a R1.00 unit and you can catch it once (100%) the - R500 000.00 Ticket will apply - dividend paid: R500 000,00

2.) If you catch 20% of a Pick Six that pays R500.000,00 to a R1.00 unit, the Odds limit of

- R500 000/1 will apply - dividend paid: R100 000,00 (R100 000,00 to 20 cents)

8.CONFIRMATION OF BETS

Only bets that have been confirmed by the operator will be deemed as valid bets.

9.FINANCIAL INTELLIGENCE CENTRE ACT NO 38 OF 2001

As from 1 July 2003 in terms of Section 3 of this act, any person depositing betting or collecting R25 000 or more must provide their full name, proof of identity and contact details.

10 INTERPRETATION

The headings in these conditions are for convenience only and are not to be taken into account for the purpose of interpreting the contract.

11.SURETYSHIP AGREEMENT

If the signatory to this agreement signs the document on behalf of a close corporation, company or Trust, the signatory hereby accepts that should the account holder not perform in accordance with its obligations in terms of this agreement, the signatory hereby interposes itself as surety and co-principal debtor in respect of the Customers obligations in terms of this agreement.
